Terms and Conditions

 

SECTION A: PROMOTION

1. Participation in this promotion is deemed to be acceptance of these Terms and Conditions. 

2. The promoter is Cedar Woods Properties Pty Ltd (ABN 47 009 259 081) of Ground Floor, 50 Colin Street, West Perth, WA 6005. Telephone: 08 9480 1500 (“Promoter”).

3. The promotion of this offer starts at 7.00am AWST on 01/10/2015 and ends at 5.00pm AWST on 26/02/2016 (“Offer Period”). 

4. If there is a dispute as the identity of the entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 

 

SECTION B: JETTY OFFER

5. The Offer entitles the purchaser (referred to as the Buyer): 

    (a) one (1) “standard approved” fixed timber jetty; and

    (b) to be built by a contactor approved by Cedar Woods Properties Limited; and

    (c) applicable to the Qualifying Land only. 

 

6. QUALIFYING LAND

The Offer applies to the following residential land lots in Cedar Woods Properties Limited residential community (Qualifying Land):

7. The Offer is available to the person/persons (referred to as the Buyer) that in respect of Qualifying Land: 

    (a) enters into: 

        (i) a contract for the sale of land (Land Contract) for Qualifying Land with Cedar Woods Properties Limited (Seller); 

    (b) pays to Cedar Woods Properties Limited the deposit required under the Land Contract: and

    (c) completes the Land Contract in accordable with its terms. 

    (d) settles as per the conditions of the Land Contract for the purchase of the qualifying land within the timeframe of required settlement (but no later than 30 June 2016). 

 

8. The Buyer is entitled to claim within two (2) years from and including the date of the Land Contract.

 

9. Buyers will not have the option to claim or choose an alternative jetty (Offer) to apply to the contracted land (Land Contract). 

 

10. The Offer is not available to the person/persons that: 

    (a) up to the 30/09/2015, has accepted contract for the sale of land that is listed in clause 25 (Qualifying Land); 

    (b) during the Offer Period, has their contract for the sale of land cancelled during the Promotion Period: and

    (c) fail to make a written claim for the jetty within two) years from and including the date of the Land Contract, Cedar Woods Properties Limited (Seller) will have no obligation to provide the jetty specified. 

 

12. The advertised price of Qualifying Land: 

    (a) does not include stamp duty on the Land Contract or Completed Home Contract (as applicable), registration fees (including registration fees in relation to the transfer of the Qualifying Land), local government change in ownership fees and any other fees or charges (including legal fees or the costs of other services) incidental to the acquisition of the Qualifying Land. Buyers will need to pay these fees and charges separately;

    (b) is subject to adjustments under the Land Contract including council rates, land tax and other statutory charges; and

    (c) is correct as at the time of publication, but may change as a result of variations or changes in local, state or federal government laws or requirements applicable to the acquisition of the Qualifying Land.

 

13. Buyers will not be able to choose alternative land that is not Land. Each such Qualifying Land is only available until sold.

 

14. Buyers must ensure that the house to be constructed on their selected Qualifying Land complies with all building covenants and design requirements applying to that land. Buyers are responsible for satisfying themselves as to the compatibility of the house with all applicable building covenants and design requirements.

 

SECTION D: GENERAL TERMS

15. Any ancillary costs associated with the offer are no included and all other expenses not outlined with the offer are the responsibility of the Buyer. 

 

16. If this promotion is interfered with in any way or is not capable of being conducted as reasonable anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion as appropriate. 

 

17. In participating in the Offer activity, the Buyer agrees to participate and co-operate as required in all editorial activities relating to this promotion, including but not limited to being interviewed and photographed. 

 

18. Any cost associated with accessing the promotion/Offer is the entrant’s responsibility and is dependent on the Internet service provider used. 

 

19. Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

 

20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for an excludes all liability (including negligence), for any loss or damage; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties (whether or not under the Promoter’s control; (b) any theft or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) redemption of, use of, taking of and/or participating in the Prize. 

 

SECTION E: PRIVACY CONSENT

21. The Promoter (Cedar Woods Properties Limited) collects personal information (“PI”) for the purpose of conducting this promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional upon providing this PI. The Promoter will also use and handle PO as set out in its Privacy Policy, which can be viewed at http://www.cedarwoods.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PO for promotional, marketing, research and profiling purposes, including sending electronic messages or telephoning the entrant. In order to do this, the Promoter may share the entrant’s details with internal employees who are contract-bound to protect the entrant’s privacy. Entrant’s may opt out of future promotional communication or request to have their information changed, edited or updated. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
